If you are ready to file for divorce but your spouse is not willing to sign the divorce papers, you can file for divorce by yourself. After you file for divorce, the next step is to make sure your spouse is “served” with a copy of the summons and complaint (and anything else you filed). The Court does not serve the papers for you.  It is up to you to make sure that your spouse is served. Once your spouse has been served with the divorce papers, you will have to wait and see what your spouse does before you know what your next step will be.
