Creating a Will
There are no self-help forms to create a will. It is always advisable to consult with an attorney if you need estate planning help to ensure your wishes are followed after your death.
If you have signed a will, keep it in a safe place and make sure your loved ones know where to find the will if they need. The court will not accept the will until after you have passed, so it is important that your trusted loved ones know where to find it later.
Submitting a Will to the Court
The Court does not accept wills until after a person dies.
- If you have the will of someone who passed away, you must submit it to the Court within 30 days of their passing. There is usually a small fee to pay.
- If someone passed away and left the will in a safe deposit box, you can file a petition for permission to access the safe deposit box for the sole purpose of obtaining the will. Visit the Safe Deposit Box page for forms and instructions.
